By purchasing any items from the website or ordering a commissioned portrait, you the buyer agree to all the terms and conditions detailed below.
No permission is given by the artist Sarah Ballard of Loch Fine Art in respect of the reproduction or use of any images or other materials on this website or commissioned work. All rights are reserved by the artist Sarah Ballard of Loch Fine Art.

Copy Right
​​
The artist reserves all copyrights of any artwork including original works and commissioned portraits. Therefore no copies should be made for personal or commercial use without the artists permission. ​As the owner of the artwork LochFine art reserves the rights to share on social media any artwork. If the commission is a gift or you would do not wish for the artwork to be shared then you must state at the time of booking.

Data Protection

Only information required to complete the order/commissions will be collected and stored for the duration of the order process. This information will only be used for payment purposes, to keep the client informed, and to complete the order. Any information supplied will not be passed on to third parties. Once the client has received the product all information is deleted, including any reference photos with the exception of clients name which will be only used to keep track/record of the commission. Information that will be collected will be as follows: Name, Email address, Home address, reference photos and payment details when completing the transaction. Please see Paypals data protection policy when choosing to pay through them.

Description of Product​​

All artwork will be produced on a white background using coloured pencils. No background image will be included unless it has been requested on time of booking. The artwork will be based on a photograph provided by the client. If a high quality photo cannot be provided then the artist reserves the right to refuse the commission.

Photograph Rights
​
​
If you are not the owner of the reference photo being provided then the permission of use must be obtained. If the photo was taken by a professional photographer then permission must be obtained from the photographer.

Payment Terms
​
​
Payment will be collected through either Paypal or Bank Transfer. A 25% booking fee will be required to secure the commission slot and to cover any materials required to begin the artwork. The booking fee is 100% refundable if the commission is cancelled prior to the starting of the artwork. This fee is non refundable once the portrait has started. If you are unhappy with the finished artwork and it cannot be resolved with minor alterations then the remaining balance will not be required and the artwork will remain with the artist. Only when the full payment has been received will the artwork be dispatched.

Dispatch, Delivery and Returns

VAT, Import Tax and Duties
​

All artwork will be carefully wrapped and packaged ready for shipping. The client will be notified when the artwork has been dispatched, from this point the length of time it takes to arrive is no longer the artists responsibility. All orders will be shipped Tracked First Class for Uk and Tracked International for international orders. If a delivery incurs any import tax, VAT or duties the customer is solely responsible for these charges. The artist (Loch Fine Art) cannot be responsible for any additional charges which may occur. In the event that the artwork is damaged in transit, photograph the damaged items and the damaged packaging and email the artist immediately: Sarah.lochfineart@yahoo.com. Damaged items should be returned to the artist within 14 days in its original packaging at the clients cost both ways including any further charges such as VAT, duties and import tax that may occur upon return. Once received another portrait will be created in the artists next available commission opening at the time of return.

Exchange Rates
​

Exchange rates will be calculated as per the current exchange rate during the time of payment. Loch Fine Art cannot be responsible for currency rate changes.

Portrait Prices
​
​
Prices are subject to change. If prices increase once a client has commissioned a portrait and the commission has been secured with payment of the booking fee, the prices will remain as they were on the day of booking the portrait.

Amendments
​
​​
You are under no obligation to pay the full remaining balance until you are happy with the final artwork. If the client feels the artwork needs amendments then alterations maybe possible providing they do not deviate from the original commission. Due to the nature of coloured pencils some alterations may not be possible, if this is the case you will be advised. No amendments will be made once the commission has been approved by the client.

Cancellations and Refunds

If for any reason you wish to cancel your commission you can do so at any time.
If you cancel before the portrait is due to start then the 25% booking fee will be fully refunded. You will be contacted to confirm when the portrait is due to start.
If you cancel once the portrait has started then the 25% booking will not be refunded and retained to help cover the cost of materials and time used to begin the commission.
If for any reason you are unhappy with the finished artwork and decide to cancel you will not be charged the outstanding balance, however the 25% booking fee will be retained by the artist along with the artwork.
You will be notified when the commission has been completed, if the outstanding payment has not been received 30 days after the notification and you have not contacted the artist to say otherwise then the artist will assume the commission has been cancelled and the artwork will remain with the artist, any payments made up to that point will not be refunded.
